Cette dernière illustre l’une des fortes traditions Ornanaises ancrées dans la vie du XVIème siècle. Grâce à elle, de nombreux vagabonds ont pu trouver refuge temporairement parmi ces villageoises et villageois au grand cœur.
Currently visible on Place Robert Fernier, not far from the Courbet Museum, the Asylum Stone is one of the last witnesses of the seigniorial past of the city of Ornans. It illustrates one of the strong Ornans traditions rooted in the life of the 16th century. Thanks to it, many vagrants were able to find temporary refuge among these kind-hearted villagers.

La Pierre d’Asile, le sésame des réfugiés
Perçue comme le sésame des réfugiés, cette pierre est très vite devenue une tradition chez les Ornanais au point de perdurer pendant plus de 160 ans !
Elle accordait à toutes personnes ayant commis un homicide par accident ou par autre circonstance susceptible d’obtenir la grâce du seigneur de séjourner temporairement au sein de la Petite Venise comtoise. De ce fait, la ville d’Ornans fut considérée comme généreuse. Ce droit dorénavant présent dans toutes les sociétés occidentales était obtenu en touchant la niche creusée dans cette colonne.
Cependant, il est bien connu qu’il ne faut pas abuser de la bonté d’autrui ! En effet, ce réfugié avait l’obligation de demander grâce dans un certain délai sous peine d’être banni une fois de plus. Cette règle est tout à fait compréhensible : la ville d’Ornans ne voulait pas « peupler de tels reprochables habitants » !
Dans le cas où la grâce seigneuriale ne serait pas accordée ou le délai dépassé, le réfugié avait interdiction formelle de se présenter au château, aux halles, au four, au moulin banal… En bref, dans tous les lieux appartenant à cette même ville.

Si cette pierre était particulièrement sollicitée par l’ensemble des réfugiés, elle fut l’objet de nombreux litiges notamment en accordant l’asile à des individus ayant commis des homicides volontaires.

J’ai volé l’argent et les bijoux d’une riche veuve, à Nans-sous-Sainte-Anne. Comprenez, j’avais besoin d’argent pour me nourrir. Aujourd’hui, tout le monde me dévisage, personne ne veut être vu avec moi, je suis perçu comme la bête noire.

Cependant, bien qu’elle soit parfois injuste, cette pratique a permis de tourner la page des vengeances privées commises lorsque la justice était mal administrée.

Ce droit, longtemps conservé au cœur de cette ville si particulière, si mythique, si historique, a connu ses derniers jours lors de la conquête de la Franche-Comté, en 1674, par les troupes du Royaume de France orchestrées par Louis XVI.

Perceived as the sesame for refugees, this stone quickly became a tradition among the people of Orléans, to the point of lasting for over 160 years!
