[ES] “La Ley de Costas española establece la necesidad de realizar un deslinde del dominio público marítimo-terrestre, es decir, establecer una línea que determine el límite entre el terreno que pertenece al mar y las playas, y que es de carácter público; y el terreno interior, susceptible de pertenecer y ser gestionado por particulares. La consideración de titularidad pública del mar y las playas no emana de esta ley, sino que está reconocida en la Constitución Española de 1978.

La realización de este deslinde corresponde a las delegaciones provinciales de la Dirección General de Sostenibilidad de la Costa y del Mar, dependiente del Ministerio de Agricultura, Alimentación y Medio Ambiente. El deslinde se puede iniciar de oficio o a petición de cualquier parte interesada, pero no tiene por qué realizarse si nadie lo solicita. Ello implica que no todo el litoral se encuentra deslindado, siendo el porcentaje de deslinde completado muy diferente según la zona. En ocasiones, el deslinde puede ser actualizado, lo que conlleva la elaboración desde el principio desde el proceso de deslindado.

Como dominio público, el terreno delimitado en el deslinde realizado no puede ser ocupado sin autorización. La ocupación solo se permite para aquellos elementos de interés público que por su naturaleza no puedan tener otra ocupación, como es el caso de los puertos.”

[EN] “The Spanish Coastal Law establishes the need to carry out a demarcation of the maritime-terrestrial public domain, that is, to establish a line that determines the limit between the land that belongs to the sea and the beaches, and which is of a public nature; and the interior land, susceptible to belonging to and being managed by private individuals. The consideration of public ownership of the sea and beaches does not emanate from this law, but is recognized in the Spanish Constitution of 1978.

The realization of this demarcation corresponds to the provincial delegations of the General Directorate of Coastal and Marine Sustainability, dependent on the Ministry of Agriculture, Food and Environment. The demarcation can be initiated ex officio or at the request of any interested party, but it does not have to be carried out if no one requests it. This implies that not all of the coastline is demarcated, with the percentage of completed demarcation being very different depending on the area. Sometimes, the boundary can be updated, which entails the elaboration of the boundary process from the beginning.

As a public domain, the land delimited in the boundary carried out cannot be occupied without authorization. Occupation is only permitted for those elements of public interest that by their nature cannot have another occupation, as is the case of ports.”
